These Terms of Service (“Terms”) govern your use of the FondMemoirs website located at www.fondmemoirs.com and any related services we provide (collectively, the “Services”).
By accessing or using the Services, creating an account, submitting content, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Services.
In these Terms, “FondMemoirs”, “we”, “us”, and “our” means FondMemoirs, and “you” means the individual using the Services.
1. Eligibility
You must be at least 18 years old to create an account, use the Services, or place an order.
By using the Services, you represent and warrant that:
- you are 18 or older;
- the information you provide is accurate and complete;
- you have legal capacity to enter into a binding agreement;
- you will use the Services only in compliance with applicable law.
We may suspend or terminate accounts that we reasonably believe belong to users under 18.
2. Our service
FondMemoirs provides a service that helps you create a memoir using your submitted voice notes, transcripts, edits, and other materials.
The Services may include:
- account access through a web browser;
- memoir interviews, prompts, or content submission features;
- transcript generation and draft preparation;
- editing, formatting, and manuscript development;
- print production and delivery, where offered.
We may update, improve, modify, or discontinue parts of the Services at any time, although we will try to avoid materially disrupting active customer orders without good reason.
3. Intended Use of the Services
FondMemoirs is provided solely for the creation, development, editing, and production of personal memoirs, life stories, autobiographical works, and similar personal storytelling projects.
You may use the Services only for their intended purpose. You may not use the Services for spam, fraud, unlawful activity, harassment, impersonation, deceptive content, abusive conduct, commercial content generation unrelated to memoirs or personal stories, or any other use that is inconsistent with the purpose of the Services.
We reserve the right to monitor usage patterns, investigate suspected misuse, and determine, acting reasonably, whether use of the Services falls outside their intended purpose.
If we believe that you have misused the Services, used them abusively, used them for purposes unrelated to memoir or personal story creation, violated these Terms, or created risk to FondMemoirs, our users, or third parties, we may suspend, restrict, or permanently revoke your access to the Services and delete or disable associated content, subject to applicable law and any obligations described in our Privacy Policy.
4. Account registration and security
You may need to create an account to use some or all of the Services.
You are responsible for:

5. Your content
“User Content” means any information or material you submit to us, including voice recordings, transcripts, written notes, photographs, comments, edits, responses, and memoir content.
You retain ownership of your User Content, subject to the rights you grant us in these Terms.
You grant FondMemoirs a limited, non-exclusive, revocable, worldwide license to host, store, process, reproduce, adapt, format, edit, transmit, and use your User Content only as necessary to:
- provide the Services to you;
- create, revise, print, and deliver your memoir;
- maintain your account;
- respond to support requests;
- comply with law and enforce these Terms.
We do not claim ownership of your life story or memoir content.
6. Your promises to us
You represent and warrant that:
- you own your User Content or have all rights necessary to submit it;
- your User Content does not infringe the rights of any person;
- your User Content does not violate privacy, confidentiality, defamation, copyright, trademark, or other laws;
- your User Content does not contain unlawful, abusive, fraudulent, threatening, or harmful material;
- any personal information you include about other people is shared lawfully and at your own responsibility.
You are responsible for the content you submit.
7. AI-assisted and editorial services
Parts of the Services may use software tools, automation, AI-assisted processing, or human review to help convert your voice notes into transcripts and memoir drafts.
You understand and agree that:
- automated outputs may contain errors, omissions, or formatting issues;
- names, dates, places, and factual details may require your review and correction;
- you remain responsible for reviewing and approving your manuscript before printing or finalization.
We do not guarantee that any draft will be error-free, perfectly complete, or suitable for a particular purpose without your review.
8. How we use your memoir materials
Your memoir materials are used solely to provide the Services you requested.
We do not use your voice notes, transcripts, or memoir content to train our models or third-party models, and we do not use that content for unrelated commercial exploitation.
Our handling of personal data is also governed by our Privacy Policy.
9. Orders, pricing, and payment
Prices, package details, delivery terms, and any promotional offers shown on the Website or at checkout form part of your order.
You agree to pay all charges, fees, taxes, shipping costs, and other amounts clearly presented to you at the time of purchase.
Payments may be processed by third-party providers. By making a purchase, you authorize the applicable payment processor to charge the payment method you provide.
If a payment fails, we may suspend work on your memoir or delay fulfilment until payment is successfully completed.
10. Refunds and cancellations
Any refund policy, satisfaction guarantee, or cancellation terms displayed on the Website, checkout page, or order confirmation will apply to your purchase.
Unless otherwise stated in writing:
- you may cancel before substantial work has begun by contacting us;
- once memoir creation, manual editing, production, or printing has materially progressed, refunds may be reduced or unavailable to reflect work already completed;
- custom printed products may be non-refundable once approved for print, except where required by law.
Nothing in these Terms limits any non-excludable consumer rights you may have under applicable law.
11. Review and approval
You are responsible for reviewing any draft, proof, preview, or print-ready version we provide to you.
Once you approve a manuscript, proof, or print version:
- you confirm that you have reviewed it;
- you accept responsibility for any remaining spelling, factual, formatting, or content issues that were visible at the time of approval;
- changes requested after approval may incur additional fees or production delays.
12. Printing and delivery
Where your order includes printed memoirs, we will arrange production and shipping using our chosen fulfilment partners or delivery providers.
Delivery times are estimates unless we expressly state otherwise. We are not responsible for delays caused by couriers, customs, incorrect address information, force majeure events, or circumstances outside our reasonable control.
Risk in printed goods passes to you on delivery, except to the extent otherwise required by applicable consumer law.
13. Intellectual property
All rights in the Website, software, branding, logos, design elements, and underlying service materials belong to FondMemoirs or our licensors.
Except as expressly allowed by law or these Terms, you may not:
- copy, reproduce, modify, distribute, reverse engineer, scrape, republish, or exploit any part of the Website or Services;
- use our name, branding, or materials without our prior written consent;
- access the Services to build a competing product or service.
This section does not take ownership of your own User Content away from you.
14. Privacy and data deletion
Our collection and use of personal data are described in our Privacy Policy.
You may request deletion of your account, memoir materials, or stored digital manuscript by contacting us. Deletion requests may affect our ability to continue or complete the Services, and we may retain limited information where required by law, accounting obligations, fraud prevention, or dispute resolution.
15. Prohibited use
You must not:
- use the Services for unlawful, fraudulent, or abusive purposes;
- upload malware, harmful code, or content intended to disrupt systems;
- interfere with the operation, security, or integrity of the Website or Services;
- attempt to gain unauthorized access to any account, system, or data;
- impersonate another person;
- use the Services in a way that infringes the rights of others.
We may suspend or terminate access for violations of these Terms.
16. Service availability

We do not warrant that:
- the Services will always be available, secure, or error-free;
- the memoir output will always be complete, perfectly accurate, or uninterrupted;
- the Services will meet every personal expectation or preference.
Nothing in these Terms excludes any warranty or right that cannot legally be excluded.
19. Limitation of liability
To the fullest extent permitted by law, FondMemoirs will not be liable for:
- indirect, incidental, special, consequential, or punitive losses;
- loss of profits, revenue, business, goodwill, or opportunity;
- loss of data, except where liability cannot lawfully be excluded;
- delays or failures caused by third parties or events beyond our reasonable control.
Our total liability arising out of or related to the Services will not exceed the amount you paid to us for the specific order or service giving rise to the claim in the 12 months before the event giving rise to liability.
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot legally be excluded or limited under applicable law.
20. Indemnity
You agree to indemnify and hold FondMemoirs, its officers, employees, contractors, and affiliates harmless from claims, losses, liabilities, and expenses arising out of:

This clause applies only to the extent permitted by law.

When we do, we will post the updated version on the Website and change the “Last updated” date. Continued use of the Services after the updated Terms take effect means you accept them, unless applicable law requires additional notice or consent.
